How to dismiss an underperforming employee

We were approached by a small business that needed advice on handling an employee with conduct issues. We talked the employer through their various options so they could make an informed decision, and they eventually opted to dismiss the employee in question based on the severity and extent of the conduct issues. We advised on the processes and procedures they needed to follow in order to minimise the risk to their business of an unfair dismissal claim.

In addition, as part of our bespoke service, we reviewed the documents the company had prepared in relation to the dismissal and suggested amendments to ensure the documentation was legally compliant and in line with HR best practice. Following the dismissal, the employee submitted a grievance, at which point we advised our client on the tone and wording of their written response. The employee did not pursue their grievance, and our client successfully avoided a potentially expensive and time-consuming employment tribunal claim.
